TERMS OF SERVICE AGREEMENT

Please read the following Terms and Conditions carefully. By purchasing any products or services from Crystal, you acknowledge that you have read, understood, and agree to be bound by these terms. Your purchase constitutes your agreement to these Terms of Service. If you do not agree with any of the terms outlined below, you must refrain from purchasing any products or services. By completing a purchase of any of Crystal’s products or services, you explicitly accept and consent to the following conditions:

Scope of Services: The services provided by Crystal are intended to offer spiritual guidance and insight based on intuitive and spiritual practices. These services aim to support your personal growth and understanding but are not a substitute for medical treatment, legal counsel, professional advice, or financial guidance. All psychic readings, services, and products are meant to empower you on your personal journey, and you are encouraged to seek professional assistance when necessary. Please use your own judgment in all matters.

Limitations of Liability: By engaging in these services, you acknowledge and agree that Crystal is not liable for any decisions made or actions taken based on the information provided during sessions. You understand that you are solely responsible for your own choices and the outcomes of those choices.

Confidentiality Clause: All information shared during sessions is confidential and will not be disclosed to any third parties without your explicit consent, except as required by law. Both parties agree to maintain the confidentiality of the content discussed during the session. Crystal will take all reasonable steps to protect the confidentiality of your communications, but you acknowledge that no system of communication is entirely secure. Crystal cannot be held liable for any breach of confidentiality beyond her reasonable control.

Mutual Non-Disclosure Agreement: You agree not to disclose any proprietary or confidential information obtained during our sessions, including but not limited to personal insights, techniques, or methodologies. Additionally, you agree not to share, publish, post, or disclose any content, insights, or materials discussed in your reading, including but not limited to emails, texts, video, or audio recordings. The content of your reading is for your personal use only. This agreement applies indefinitely and to all readings, including those you may engage in with Crystal in the future.

Final Sale and Payment Terms: All sales are final. Once payment is made for a reading, a crystal, or for any other product or service that Crystal offers, it is non-refundable. You acknowledge that you understand and accept this policy. Indemnification and Release of Liability: By signing this agreement, you agree to hold harmless and indemnify Crystal from any liability, claim, or legal action arising from your reading or use of any products or services Crystal offers. You understand that you are engaging in spiritual guidance at your own risk and that Crystal is not responsible for any outcomes.

Damage Limitation Clause: In no event shall Crystal's liability exceed the total amount paid by you for the specific product or service in which the dispute arose. By purchasing Crystal’s product or service, you acknowledge and agree that this limitation of liability applies regardless of the nature of any claim, whether in contract, tort, or otherwise.

Non-Disclosure of Communications: All verbal, written, or electronic communications between Crystal and the client are considered confidential. You agree that no communication, including emails, text messages, audio, or video recordings, will be disclosed or shared with any third party without your prior written consent, except as required by law. Crystal reserves the right to retain records of your communication for the purpose of providing services, but these records will not be shared or disclosed without your consent, except in response to a legal requirement such as a subpoena or court order.

No Recording of Sessions: You agree not to record, copy, or otherwise capture any part of the psychic reading or other communications with Crystal, whether in audio, video, or any other format, without the prior written consent of Crystal. Any unauthorized recordings are prohibited and may be subject to legal action.

Mandatory Arbitration and Dispute Resolution: By signing this agreement, you agree that any dispute, claim, or controversy arising out of or relating to this agreement, the services provided, or any interaction between you and Crystal shall be resolved exclusively through binding arbitration. You hereby waive your right to file any lawsuit, claim, or cause of action in court. Before initiating arbitration, the parties agree to engage in good faith negotiations and attempts at informal dispute resolution. If a dispute cannot be resolved informally within 30 days of the initial notice of dispute, either party may then initiate arbitration proceedings.

Venue and Jurisdiction: The parties agree that any arbitration will take place in the State of Wyoming. And both parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming for any matters related to the enforcement or interpretation of this agreement. This agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.

No Guarantees or Warranties: You understand and acknowledge that Crystal does not guarantee any specific results or outcomes from the services provided. Any actions you take based on the information provided are at your own discretion and risk.

No Liability for Third-Party Interactions: Crystal is not responsible for any interactions or consequences arising from your engagement with third parties based on the information or advice provided during the reading. This includes, but is not limited to, relationships, business transactions, or personal decisions. You agree to hold Crystal harmless for any such outcomes.

Mandatory Arbitration Clause By purchasing Crystal’s products or services, you agree to resolve any dispute, claim, or controversy arising out of or relating to these terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, exclusively through final and binding arbitration. This arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes.

Venue and Jurisdiction: The arbitration will take place in the state of Wyoming. You and Crystal agree to submit to the exclusive jurisdiction of the arbitration proceedings in Wyoming and waive any right to a trial by jury or to participate in a class action lawsuit. The arbitration shall be conducted in Sheridan, Wyoming, and administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or other applicable rules as determined by AAA.

Governing Law: These terms and any disputes arising out of or related to these terms or our services shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.

Waiver of Right to Sue: By purchasing Crystal’s products or services, you waive any right to bring a lawsuit in court or to have a jury trial for any disputes or claims that arise out of or are related to these terms or our services. You understand and agree that you are relinquishing your right to sue in court and that all disputes will be resolved exclusively through binding arbitration in Wyoming. If any terms of service provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment: By purchasing Crystal’s products or services, you acknowledge that you have read, understood, and agreed to the terms of this mandatory arbitration clause and venue designation.

By purchasing Crystal’s products or services, you also agree to the following:

Class Action Waiver: You agree that you will not initiate, participate in, or be a member of any class action, collective action, or representative action related to any claims, disputes, or controversies arising out of or related to these Terms of Service, the use of Crystal's services, or any products or services offered by Crystal.

Individual Disputes Only: Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the products or services provided by Crystal must be resolved on an individual basis, and you waive any right to initiate, join, or participate in any class, consolidated, or representative action or proceeding.

No Class Arbitration: You further agree that, in the event of any arbitration proceeding, the arbitration shall be conducted solely on an individual basis, and no arbitration proceeding shall be joined with any other proceeding, or include a class action or representative action.

Privacy Policy: Crystal values your privacy and is committed to protecting your personal information. This Privacy Policy outlines how the information you provide is collected, stored, and used.

Information Collection: Crystal may collect the following personal information from you: Name, Birthdate, Payment information, Shipping address, Contact details (email, phone number), and/ or Other information relevant to your services.

Use of Information: Crystal uses your personal information for the following purposes: To provide and improve services, To process transactions and send you related information, including purchase confirmations and invoices, To communicate with you, including sending you updates, newsletters, and promotional materials

Data Storage and Security: Crystal takes reasonable measures to protect your personal information from unauthorized access, use, or disclosure. Your information is stored securely and only accessed by authorized personnel.

Sharing of Information: Crystal does not sell, trade, or otherwise transfer your personal information to outside parties without your consent, except to trusted third parties who assist in operating Crystal’s business, conducting services, fulfilling orders, or providing service to you, as long as those parties agree to keep this information confidential.

Right to Refuse Service: Crystal reserves the right to refuse service to any client for any reason, including, but not limited to, inappropriate behavior, threats, or abuse. If service is refused, the client will be refunded any payments made for services not rendered, but no further claims can be made.

No Substitute for Professional Services: You acknowledge and agree that the services provided by Crystal are not a substitute for professional psychological, medical, legal, financial, or other professional services. You should not disregard or delay seeking professional advice due to the information received during a session. Crystal encourages you to consult with appropriate professionals when needed.

Force Majeure: Neither party shall be held liable for any failure or delay in performance under this agreement due to events beyond the reasonable control of the party affected, including, but not limited to, government regulations, war, terrorism, civil unrest, strikes, or other unforeseeable events. In such cases, performance shall be suspended for the duration of the event, and both parties shall attempt to reschedule services when possible.

These Terms of Service (the “Agreement”) are between you (the “Customer”) and Crystal Stone, a Limited Liability Company (LLC), referred to here as "Crystal”. By purchasing any of Crystal’s products or services, you agree to comply with and be bound by these Terms of Service. As an LLC, Crystal operates under the legal protections and responsibilities afforded to this business structure. Any transactions, services, or interactions with Crystal are governed by the terms and conditions set forth in this agreement and applicable laws for LLCs.

No Transfer of Rights: You acknowledge that you are entering into this agreement solely for personal use and that the rights granted hereunder are not transferable to others. You agree not to assign, transfer, or sublicense any rights, obligations, or materials associated with this agreement to third parties.

Intellectual Property Rights: All intellectual property, including but not limited to the methodologies, techniques, writings, emails, text messages, audio, video, and other content provided during the reading, remains the exclusive property of Crystal. You agree not to use, reproduce, or distribute any of Crystal's intellectual property without express written consent.

Client Responsibility for Own Actions: By purchasing Crystal’s products or services, you acknowledge that you are responsible for your actions, decisions, and any consequences that may result from them. You agree to take full responsibility for any personal or business decisions made following a reading or use of a crystal, or any product or service Crystal offers, and release Crystal from any liability associated with those decisions.

Termination of Agreement: Crystal reserves the right to terminate this agreement and discontinue services at any time, in the event of any violation of the terms outlined herein or for any other reason at her discretion. Upon termination, the client will not be entitled to a refund, except in the case where services were not provided.

Severability: If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be amended to the minimum extent necessary to make it enforceable, and the remainder of the agreement will remain in full force and effect.

Arbitration and Legal Action: By purchasing any products or services, including crystals or psychic readings, from Crystal, you acknowledge and agree to the following additional terms:

Binding Arbitration: You agree that any disputes, claims, or controversies arising out of or in connection with your purchase, use of products, or services, including psychic readings, shall be resolved through binding arbitration. This includes, but is not limited to, disputes related to the interpretation or enforcement of this agreement, and any other claims related to your relationship with Crystal. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA). The decision of the arbitrator(s) shall be final and binding on all parties, and any award may be entered as a judgment in any court of competent jurisdiction. The decision of the arbitrator(s) shall be final and binding on all parties.

Right to Seek Remedy in Court or Arbitration: While you, the client, agree to resolve disputes through arbitration, Crystal reserves the right to seek a legal remedy in a court of competent jurisdiction or through arbitration, at Crystal’s discretion. Crystal may choose the appropriate forum in which to pursue legal action or claim, as permitted by applicable law, and may seek remedies including, but not limited to, injunctive relief, specific performance, or damages in the event of a breach of this agreement.

Right to Legal Action for Breach: In the event that you breach any of the terms of this agreement, including but not limited to violations of confidentiality provisions, non-disclosure agreements, intellectual property rights, or any other clauses outlined herein, Crystal reserves the right to pursue legal action. Crystal may seek to enforce the terms of this agreement and recover any damages, losses, or harm caused by the breach, including but not limited to financial losses or harm to Crystal's reputation, intellectual property, or business interests. This may include pursuing legal remedies in court, if appropriate, or through arbitration, as described above.

Enforcement of Terms: In the event of a legal dispute, both parties are bound to these provisions, and Crystal may seek enforcement of any decision or award granted in arbitration through the courts, if necessary. By purchasing any of Crystal’s products or services, you acknowledge and agree to these terms, including your commitment to arbitration and Crystal's right to pursue remedies in either arbitration or court as outlined above. If you do not agree to these provisions, you must refrain from making a purchase or engaging with any services offered by Crystal.

Copyright Clause- Copyright and Intellectual Property Ownership: By purchasing a psychic reading or service from Crystal, the client acknowledges and agrees that all readings, content, and materials provided by Crystal (including but not limited to written, recorded, or spoken readings) are the exclusive intellectual property of Crystal and are protected by copyright law. The client understands that all psychic readings and associated content are copyrighted and cannot be reproduced, shared, distributed, or publicly displayed in any form without explicit written consent from Crystal.

Restrictions on Use: Non-Transferable License: The client is granted a personal, non-exclusive, non-transferable license to use the reading solely for their personal, non-commercial purposes. The client may not, under any circumstances, share, distribute, sell, publish, or otherwise make the reading available to any third party, including posting it online or on any public platform (such as websites, blogs, social media, etc.), without express prior written permission from Crystal.

Prohibited Sharing and Posting: The client agrees that they will not post, upload, or share the reading or any excerpts from the reading on social media, websites, forums, or any other online platform. This includes, but is not limited to, platforms such as Facebook, Instagram, Twitter, YouTube, TikTok, or any other public facing websites. Any unauthorized publication of the reading whether for commercial or non-commercial purposes, will be considered a violation of Crystal's copyright and will result in legal action.

Copyright Enforcement: Any unauthorized use, including online publication, reproduction, or distribution of the psychic reading or related content, will be subject to legal action, including but not limited to claims for statutory damages, attorney's fees, and injunctive relief to prevent further infringement. Crystal reserves the right to take all necessary steps to protect its intellectual property.

Non-Disclosure Agreement (NDA) Clause-Confidentiality and Non-Disclosure of Readings: The client agrees that all psychic readings provided by Crystal are confidential and are intended solely for the personal use of the client. The client agrees to the following terms regarding the disclosure of readings:

Confidential Nature of Readings: The client acknowledges that the psychic reading and all related materials are confidential and the intellectual property of Crystal. The client agrees that they will not disclose, publish, share, or make the reading available to any third party under any circumstances, including but not limited to publishing or sharing it on any online platform (e.g., social media, blogs, websites, forums).

No Sharing or Public Posting: The client agrees not to post, upload, or share the full reading or any portion of the reading on any online or public-facing platform, including but not limited to social media platforms (e.g., Facebook, Instagram, Twitter), websites, blogs, or any other online media. This prohibition applies to any form of online publication, whether for personal, educational, or commercial purposes.

Breach of Confidentiality: Any unauthorized sharing or publishing of the psychic reading online, whether for commercial or non-commercial purposes, will constitute a material breach of this agreement and may result in legal consequences. The client understands and agrees that if they breach this clause, Crystal may seek legal action, including but not limited to injunctive relief, damages, and termination of any ongoing or future services.

Consequences of Breach: In the event of a breach, Crystal reserves the right to pursue any and all legal remedies available, including seeking financial compensation for damages, legal fees, and the removal of the infringing content. The client agrees to fully indemnify Crystal from any losses, damages, or legal costs arising from the unauthorized publication or disclosure of the reading.You acknowledge that any breach of the confidentiality clause or any other material provision of this agreement may cause Crystal significant harm, and you agree that Crystal has the right to pursue appropriate legal remedies, including injunctive relief, damages, and any other available legal actions. Crystal will not be required to mitigate damages or to seek alternative dispute resolution in cases where there is a material breach.

Legal Agreement and Electronic Signature: By purchasing a psychic reading or by purchasing any of Crystal’s products or services, you affirm that you are the person you claim to be, you affirm that you are at least 18 years old, and you affirm that you are legally able to enter into this agreement. (If you are under the age of 18, you are prohibited from using Crystal’s products or services, and you agree not to submit any personal information or make any purchases from Crystal.)

You understand and affirm that by completing your purchase, you are providing an electronic signature, which holds the same legal effect as a traditional handwritten signature. By making a purchase of any of Crystal’s products or services, you agree to be bound by all the terms stated herein. This agreement applies to every reading you receive with Crystal and every product or service you purchase from Crystal in perpetuity, and no additional signatures will be required for future readings.
